NEW BUSINESS:
1. File # W2000-48-Application for a wetlands permit for the construction of a 2-car garage within the regulated area located at 157 Old Farms Road. Harold Hemmingsen Sr. owner/applicant. (Received on 09/25/00, no decision before 10/09/00, decision by 11/27/00).
The commission reviewed the file.
D. Schreiber read the applicant's letter into the record.
D. Schreiber said it appears that only one small corner of the building is going to be in the regulated area. The applicants are asking for agent approval.
T. Gutowski asked about the reserve system.
Harold Hemmingsen said he had been informed the sanitarian has approved the plan. The septic was redone back in 1990.
G. Blessing said this building addition plan was approved by the sanitarian 09/20/00.
S. Yorgensen said they have an area for 100% code compliance.
G. Blessing said previously, there was no reserve area there. It was not mandatory that a reserve area be supplied when it was redone in 1990.
H. Hemmingsen described the layout of the property.
S. Yorgensen said a reserve area is not needed except for when they are initially building.
The commission reviewed the subdivision map.
G. Blessing said there really appears to be no activity close to the wetlands.

2. File #W2000-34-Application for a wetlands permit for the construction of a single-family home including driveway and septic off Spak Road (Map 51, Lot 1A, 20.57 acres). Michelle Wittenzellner owner/applicant. (Received on 07/24/00, no decision before 08/07/00, hearing or decision by 09/25/00).
Steve Klimkoski of Filip Associates spoke on behalf of the applicant.
S. Yorgensen said last time, there was information missing on the plans. Since then they have been revised but the office does not have a most-recent copy yet. Karl does have revised plans and he has written a memo dated today.
G. Blessing asked Mr. Klimkoski if he had been given a copy of the memo.
S. Klimkoski said Yes, and noted Karl was concerned with the 100-year flood limit. He submitted larger scale plans of the area for the record.
D. Schreiber said he assumed there was no frontage on the back portion of the property.
S. Klimkoski said that was correct.
S. Yorgensen asked if it was all the same lot.
S. Klimkoski said Yes. The driveway entrance is off of Spak Road. There is a small pocket of wetlands there to be filled in. Some clearing has been done on the site, with no connection to the wetlands. There are some stumps in the area from a long time ago. He reviewed the layout of the property and driveway path. He said the proposed driveway is as far from the wetlands as it can be. Test pits have been done on the property.
S. Klimkoski reviewed potential alternatives and said this is an approved subdivision, and it is a Lot of Record. The test pits are where the house plan was, as approved in 1981. The proposed house is in the same area but the driveway was not previously shown. It is basically a level area and the pond is about 3 acres in size. It was designed in the 1950-60's by SES when they used to do ponds for conservation. He reviewed the topography and elevation and noted the owner has never seen water in the area except for one time when beavers backed it up, but that has been remedied. The area by the pond is mostly grass cover.
G. Blessing asked how much area was to be filled in for wetlands.
S. Klimkoski said .016 acres will be altered, almost 700 square feet.
G. Blessing asked about alternatives.
S. Klimkoski reviewed the plans.
S. Yorgensen asked if the area had been flagged.
S. Klimkoski said Yes, it was done by Richard Zulick. He submitted the report.
G. Blessing asked about the limits of construction and clearing.
S. Klimkoski reviewed the information.
T. Gutowski asked if it had been excavated and burmed.
S. Klimkoski said Yes, and an area is left for access overflow.
D. Schreiber asked if the house will or can have a basement.
S. Klimkoski said Yes, and reviewed an analysis on watershed. The house is protected.
D. Schreiber asked if the stockpile area was shown on the map.
S. Klimkoski said No.
D. Schreiber said one will be needed since they will be digging for a basement.
G. Blessing said the basement will be below the water table.
S. Klimkoski said there was no water there with the test pits.
G. Blessing said it will be close to hitting water.
S. Klimkoski reviewed the calculations of the water table and finished basement floor. He said the figures on the map are the highest season.
G. Blessing said it looks like it will be within two feet.
D. Schreiber said they could have a very wet basement.
G. Blessing asked how the commission can know they will not be bulldozing and clearing trees near the pond.
S. Klimkoski said they got direction from Karl as to the replanting. He reviewed the area that will be grassed. He noted a couple revisions Karl pointed out are not yet on the map, since the information was just received today. They will be making those changes in accordance with the report.
The commission reviewed the memo from Karl and the map.
S. Yorgensen asked why the narrative listed the "owner at time of construction."
S. Klimkoski said it is there in case the property is sold. The owner and sub-divider are also listed on the plans.
T. Gutowski said no one on the commission has seen the site, and she recommended a sitewalk.
The commission agreed it was appropriate to ask for an extension since they just received the plans tonight and Karl has not the seen final revisions.
S. Klimkoski submitted a form signed by the applicant granting a 65-day extension.
The commission set a sitewalk for 9 a.m. Saturday, September 30th.
T. Gutowski said she was still concerned with the potential for a wet basement.
S. Klimkoski said if the basement is constructed correctly, it will not be wet.
3. File #W2000-32-Application for a wetlands permit to replace existing bridge with a new bridge on Village Hill Road approximately one-third of a mile east of the intersection with Route 32 where it crosses Roaring Brook. Town of Willington owners/applicants. (Received on 06/12/00, no decision before 06/26/00, public hearing on 09/11/00, continued to 10/23/00, decision by 11/27/00).
Public hearing is continued to 10/23/00.

STAFF REPORT AND DISCUSSION:
First Selectman John Patton inquired as to the requirements and necessary permits for installation of a fence located within Hall's Pond, which he hopes to install in an effort to eliminate trespassing. Mr. Patton said boaters are acting carelessly on the pond, doing "donuts" and causing excessive wakes which are damaging the shoreline and causing erosion. He drew a rough sketch outlining the layout of the fence. He noted signs would be posted to make the trespassers aware of the fence and asked the correct procedures to begin the process.
The commission reviewed the regulations and determined a public hearing would not be necessary for this since it is not a significant activity. They stated a permit would be required.
J. Patton said there is an A-2 survey of the property available.
The commission discussed delegation of files and applications to staff for decision, and noted it would be helpful to have Gary Jones, who is now certified, also (in addition to Sue) able to issue permits in such incidences. The commission agreed it was still best to keep the same procedure, whereas files would first come before the commission. If the commission determines it is an issue which can be handled by staff or where no jurisdiction applies, it will be turned over to staff at that time by majority vote.

BLESSING MOVED TO AUTHORIZE ASSISTANT ZONING AGENT GARY JONES, IN ADDITION TO ZONING AGENT SUE YORGENSEN, TO ACT AS DESIGNATED AGENT FOR THE IWWC COMMISSION AND ISSUE ANY WETLANDS PERMITS (UPON REVIEW AND APPROVAL) IF AND WHEN A FILE HAS BEEN REMANDED TO STAFF FOR DECISION BY VOTE OF THE COMMISSION.

F. Dirrigl noted that after having worked recently on a wetlands project in another Connecticut town, this commission, comparatively, is a pleasure to deal with.
